Newfund's first fund dates back to July 2008. Today, the funds under management exceed €250M. They operate under the legal status of Fonds Professionnel de Capital Investissement (FPCI, the French Limited Partnership) and Fonds Commun de Placement à Risques (FCPR, open to non-professional investors), under french law.

 

The management company is Newfund Management, registered with the Autorité des Marchés Financiers (AMF) under the number GP08000028. Newfund Management is a Société Anonyme with a capital of  €500,000. It is independent from all financial institutions.

 

Newfund NAEH, a FCPR, is registered with the AMF under the number FCR20180015.

 

Newfund Management is a member of France Invest. It complies with the AIMF Directive (Directive AIFM).

 

The website www.newfundcap.com is the property of and was designed by Newfund Management.

Newfund Gmail Extension is a productivity app which connect the Newfund Internal CRM to Gmail.

 

With this extension you can:

- Display your CRM embedded in the Gmail interface

- Search and know which Gmail recipient is in the CRM

- Easily create / edit a contact, an account or a deal from a Gmail thread

 

Newfund Gmail Extension is a productivity app that aims to reduce our investors' time on our internal CRM by providing an embedded version of it next to the Gmail interface.

 

With respect to the collection, processing, storage and sharing of User Data, the extension:

- Collects the user's personal communications and specifically the emails opened by the user when using the Gmail service.

- Does not process personal data.

- Does not store personal data.

- Shares the user's personal communications (emails) with the CRM injected in the Gmail service interface.

Terms of Use for Newfund + application

(Effective as of July 1st, 2023)

    1. Legal notice

This application for mobile devices or tablets (hereinafter, the "Application"), is published by Newfund Management, a French Société Anonyme with a capital of € 500,000 registered with the Paris trade register under number 501 215 115 with headquarters at 58 rue de l’Arcade, 75008 Paris, France (hereinafter, “NEWFUND” or “We”). NEWFUND can be reached at the following e-mail address: [email protected] or by telephone [TEL].

 

The intra-community VAT number is FR51501215115.

The publication director is Patrick Malka, in his capacity as Director and can be contacted at the e-mail address [email protected] or by telephone at [TEL].

The application is hosted by AWS, identified under SIREN number 487482143, whose registered office is located at 52 RUE DU PORT 92000 NANTERRE, France and can be reached by telephone at 01-46-17-10-00.

 

    2. Purpose

These terms of use (hereinafter, the “Terms of use”) are intended to govern access to and use of the Application.

Any person who downloads, accesses or uses the Application is defined below as a "User" or “You”.

By downloading and using the Application, the User agrees to be bound by these Terms of use and any other policies, terms or other documents that may be published from time to time, which are expressly incorporated herein by reference.

If you do not agree to the Terms of use, You shall not download, install, copy, or otherwise use the Application.

NEWFUND may modify these Terms of use at any time and from time to time by updating this page, and your use of the Application after such modification confirms your acceptance of the modified terms. Please check these Terms of use for modifications.

We recommend that You print a copy of these terms for future reference.

 

    3. Access to the Application

Access to the Application is strictly reserved to limited partners of NEWFUND. To access the Application for the first time, You must enter your e-mail address and agree with the Terms of use. NEWFUND will send You an e-mail with a connection link to the Application. 

For future connections, You may have to sign in again with your e-mail address and follow the connection link sent to your e-mail address.

    4. Security

You are responsible for maintaining the confidentiality of your e-mail address to connect to the Application. You must take all reasonable precautions to prevent loss, theft or unauthorized or fraudulent use of your device, and account information. You are responsible  for all activities that occur under your account.

NEWFUND reserves the right to disable any user identification code, allocated by NEWFUND, at any time, if in our reasonable opinion You have failed to comply with any of the provisions of these Terms of use.

You undertake to inform NEWFUND at [email protected] as soon as reasonably practicable if You know or suspect that someone else is able to access your device or the Application, or if your device has come into possession or control of any unauthorized person.

 

    5. Specifications of the Application

When using the Application, You may:

  • Have an overview of your assets managed by NEWFUND by clicking on “My Assets”;
  • Follow up on NEWFUND’s activities and in particular:
    • track which founders / companies are of interest to NEWFUND;
    • access information on these founders / companies (Founders’ Linkedin profiles, description of the activity…
    • follow the evaluation process (pitch deck received, meeting with NEWFUND, status…); 
  • Find information about NEWFUND funds;
  • Send NEWFUND information on founders / companies / potential limited partners which may be of interest to NEWFUND.

 

    6. Intellectual Property

NEWFUND is the owner or the licensee of all intellectual property rights in the Application (software, database structure…), and in the material published on it (information, analysis, photos, graphic design, logos, sounds…). Those works are protected by copyright laws and treaties around the world. They may not under any circumstances be reproduced, used or represented without the express written authorization of NEWFUND, subject to legal action. All such rights are reserved.

In connection with viewing and using the Application, NEWFUND grants the User a non-exclusive, non-transferable right of use the Application and the material published on the Application. This right is granted for your personal reference and/or informational purposes only. 

You are not permitted to: (i) resell or use the Application or its content for commercial purposes; (ii) collect and use any information published on the Application, (iii) download or copy information for the benefit of third parties; (iv) use data mining, screen scraping, or similar data-gathering and extraction tools; (v) modify the content of the Application in any way. 

The downloading of any information, content, or images from the Application does not transfer any right or ownership of such items to the User, and such information, content, or images may be used solely in accordance with these Terms of use.

 

Any unauthorised access, modification, or change of any information, or any interference with the availability of or access to the Application is strictly prohibited.

 

    7. Contents and hyperlinks

The Application may include links to other sites or other Internet sources. Insofar as NEWFUND cannot control these external sites and sources, NEWFUND cannot be held responsible for the availability of these external sites and sources, and thus declines all responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources. These links are offered to users of the Application as a service. The decision to activate the links is yours alone.     8. Disclaimer of warranty and liability

The Application is provided "as is" and without warranty. NEWFUND has no obligation to correct any bugs, defects or errors in the Application, or to otherwise support, maintain, improve, modify, upgrade, update or enhance the Application. 

You acknowledge and agree that from time to time, the service may be delayed, interrupted or disrupted for an indeterminate period of time due to circumstances beyond the reasonable control of NEWFUND including, without limitation, any inaccuracy, interruption or delay in transmission by the telecommunications carrier used with the device to access the wireless web, or any interruptions, disruption or failure in the provision of the service.

NEWFUND cannot be held liable for any direct or indirect damage that may result from access to or use of the Application and/or this information, including inaccessibility, loss of data, lost profits, damage, destruction or viruses that may affect the User's device.

Although NEWFUND endeavours to provide reliable content on its Application, it does not guarantee that its content is free from inaccuracies or omissions and cannot be held liable for errors or omissions or for the unavailability of information and services. NEWFUND reserves the right at any time and without notice to make improvements and/or changes to the content of the Application. Consequently, the User acknowledges using his information under his exclusive responsibility.

 

    9. Personal data (privacy policy)

When using the Application, the User may be required to provide certain information that allows him/her to be identified directly or indirectly. This information will be used in accordance with this privacy policy and for the processing purposes agreed by the User.

When transmitting information to NEWFUND on founders and potential limited partners which may be of interest to NEWFUND, the User confirms that he/she has obtained prior consent from the persons concerned to transfer their personal information to NEWFUND.

Personal data transmitted by the User when using the website is hereinafter referred to as the “Data”.

In this privacy policy, the terms “Personal data” and “Controller” must be interpreted in accordance with the French Law No. 78-17 of 6 January 1978 as amended, known as the “Loi Informatique et Libertés” and the European Regulation No. 2016/679 of 27 April 2016, known as the “General Data Protection Regulation”.

    9.    b) Data collection and data processing

The Controller may collect or process the following Personal data provided by the User through the use of the Application: 

  • Name;
  • First name;
  • E-mail address;
  • Telephone number;
  • Name, e-mail address of founders and potential limited partners which may be of interest to NEWFUND.

 

All fields marked with an asterisk are required and must be completed. Any missing information to a mandatory field is likely to compromise the processing of the User’s request.

NEWFUND may automatically collect and generate information from and about You when You interact with the Application, which may include the following categories of personal information:      

  • Unique identifiers: We might automatically collect information that uniquely identifies you or the device through which you interact with the Application, such as your device and mobile advertising identifiers, IP address, social media identifiers.
  • Device information: We might automatically collect information pertaining to the device through which you interact with the Application, such as the type of device used to interact with the Application, that device’s operating system and version.
  • Interaction Information: We might automatically collect information about your interaction with the Application, such as the content You view and features you access on the Application, whether and how You interact with content available on the Application, and the search terms you enter on the Application. 

 

    9.   c) Processing purposes

Personal data are processed for the purpose of providing the User with the service and the Application. 

Data may also be used to send e-mails for information (newsletters) and/or commercial prospecting purposes during the Data retention period provided that information relates to one or more services of NEWFUND. 

You may unsubscribe at any time by clicking on the link mentioned in the newsletter or e-mail. 

 

    9.   d) Legal basis for processing

The legal basis for the processing is the performance of a contract concluded with NEWFUND. 

 

    9.   e) Data retention period

Data are kept for three (3) years after the termination of the contractual relationship between NEWFUND and You. 

During this period, NEWFUND undertakes to implement all necessary measures to ensure the confidentiality, integrity and security of the Data, in order to prevent, in particular, access by unauthorized third parties.

 

    9.   f) Recipients and data transfer

Data are processed by NEWFUND’s personnel only for the purposes intended.

NEWFUND undertakes not to sell the Personal data and not to transfer the Personal data outside the European Union. In the event that the NEWFUND uses a processor to transfer data outside the European Union, it undertakes to ensure that this processor provides sufficient guarantees regarding the implementation of appropriate technical and organizational measures.

    9.   g) Users’ rights

Push notifications/Alerts. If You have permitted the Application to send You push notifications or alerts, You can deactivate these messages at any time in the notification settings on your mobile device.

In accordance with the “Loi Informatique et libertés” and the General Data Protection Regulation, You have the right to access to, object to and rectify or erase your Data, the right to restrict of processing and the right to the portability of your Data.

You may exercise your rights by sending an e-mail to [EMAIL] or by clicking on the unsubscribe link available at the bottom of an information e-mail sent by the data controller to the User.

If You are not satisfied with our answer, You may contact the French Commission Nationale de l’Informatique et des Libertés (www.cnil.fr). 

    9.   h) Cookies

NEWFUND does not use cookies in the Application. However, by clicking on links in the Application, You may access to third parties websites or applications which may use cookies. You should refer to the cookie policy of such external websites or applications. 

 

    10. Severability

Should one or more of the provisions of this agreement be declared null and void by an act or regulation, or by final decision of a court of competent jurisdiction, they shall be deemed not written and the other provisions herein shall remain in full force and effect.

 

    11. Applicable law – Jurisdiction

These Terms of use are governed by, and shall be construed in accordance with French law.

Any dispute arising out of the interpretation, performance, expiry or termination of this agreement shall be brought before the Paris Commercial Court (Tribunal de Commerce de Paris) which shall have exclusive jurisdiction to settle the dispute regardless of where the Service is performed or the domicile of the defendant. The Parties expressly agree that this clause also applies in case of summary procedure, multiple defendants or appeals.
